Terms of Service — Hexshroom

1. Agreement to Terms & Operator

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Conley Creative LLC (“Company”, “we”, “our”, or “us”) governing your access to and play of the 3D arcade runner game Hexshroom, available at hexshroom.com and affiliated online distribution channels.

By accessing or playing Hexshroom, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue playing immediately.

2. Eligibility & Age Requirements

Hexshroom is a general audience game intended for users who are at least 13 years old (or the minimum legal age for digital consent in your jurisdiction). If you are between the ages of 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. In-Game Virtual Currency (Spores) & Cosmetic Content

No Real-World Monetary Value: Virtual Spores, cosmetic runner skins, themes, and badges are purely in-game digital items provided solely for your personal, non-commercial entertainment.

Gameplay Progression Only: Spores are earned strictly by completing rhythm runs, collecting nodes during gameplay, completing achievements, or voluntarily viewing optional rewarded video advertisements.
Non-Redeemable & Non-Refundable: Spores cannot be exchanged, redeemed, or transferred for real-world legal tender, fiat currency, cryptocurrencies, cash equivalents, or tangible goods from Conley Creative LLC or any third party.
Limited License: All virtual items are licensed, not sold. Conley Creative LLC retains all ownership rights in all game assets. We reserve the right to manage, regulate, adjust, rebalance, or remove virtual items and currency rates in connection with game updates or balance tuning.
No Property Interest: You acknowledge that you do not acquire any personal ownership or property interest in Spores or cosmetic items unlocked within the game.

4. Fair Play, Leaderboards & Prohibited Conduct

Hexshroom features competitive Endless Leaderboards and peer challenge links. To maintain fair and competitive leaderboards for all players, you agree not to:

Use automated scripts, bots, hacks, memory injectors, speed-multipliers, or third-party cheat engines to manipulate score calculations, player collision, speed, or distance.
Artificially submit counterfeit scores or forged telemetry packets to our cloud leaderboard backend.
Decompile, reverse engineer, or attempt to derive the proprietary source code or assets of Hexshroom, except as permitted by applicable law.
Exploit game bugs, glitches, or unintended vulnerabilities for leaderboard inflation or currency duplication, and instead report such defects to support@hexshroom.com.
Submit offensive, vulgar, abusive, or trademark-infringing runner callsigns or usernames.

Conley Creative LLC reserves the right to remove suspect, non-authentic, or manipulated scores and disqualify or block offending players from participating in public leaderboards.

5. Health, Photosensitivity & Assumption of Risk

Health & Seizure Advisory: Hexshroom is an intense psychedelic 6-sided rhythm runner containing flashing lights, rhythmic visual pulses, rapid camera rotations, and high-contrast color shifts.

Prior to playing, you agree to review our complete Photosensitivity & Motion Warning. You understand and acknowledge that playing fast-paced visual games entails certain risks, including motion discomfort or epileptic triggers in susceptible individuals. You agree to cease playing immediately if you experience dizziness, disorientation, visual disturbances, or physical discomfort.

6. Intellectual Property Rights

All title, copyright, and intellectual property rights in and to Hexshroom—including but not limited to the game design, 3D assets, textures, visual artwork by Elizabeth Conley, original audio compositions, sound effects, characters, logos, trademarks, and underlying software code—are owned exclusively by Conley Creative LLC and its licensors.

You are granted a limited, personal, revocable, non-exclusive, non-transferable license to play Hexshroom on web browsers for personal, non-commercial entertainment.

7. User Accounts & Cloud Save Service

Hexshroom offers optional cloud save synchronization and PIN-protected profiles via Firebase Authentication and Google Cloud Firestore. You are responsible for safeguarding your login credentials or local browser access. Conley Creative LLC cannot guarantee recovery of game progression if you clear your browser storage without backing up via an authenticated cloud save slot.

8. Disclaimer of Warranties

HEXSHROOM AND ALL ACCOMPANYING WEB SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CONLEY CREATIVE LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE GAME WILL BE UNINTERRUPTED, BUG-FREE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONLEY CREATIVE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR PLAY OF HEXSHROOM, INCLUDING DATA LOSS, DEVICE MALFUNCTION, OR HEALTH ADVISORY INCIDENTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Modifications & Contact

We reserve the right to update or modify these Terms at any time. Significant updates will be noted with a revised effective date on this page. Your continued play of Hexshroom after any changes constitutes acceptance of the modified Terms.
